The Court of Appeal has struck out the suit filed by Justice Walter Onnnoghen against a motion exparte that ordered him to step aside as Chief Justice of Nigeria.
According to the court, since the substantive case has been heard and concluded at Code of Conduct Tribunal , there is no need to go into the merit of the intelocutory appeal.
